Article 1 - Ce contrat concerne un forfait séjour proposé par la SARL Château du Pommoy, 10 rue des Meillerants, 71550 Roussillon-en-Morvan. / This contract concerns a package stay offered by SARL Château du Pommoy, 10 rue des Meillerants, 71550 Roussillon-en-Morvan

 

Article 2 - durée du séjour : Le participant signataire du présent contrat conclu pour une durée déterminée ne pourra en aucune circonstance se prévaloir d'un quelconque droit au maintien dans les lieux à l'issue du séjour/ Duration of stay: The participant signing this contract concluded for a fixed period may not under any circumstances claim any right to remain on the premises at the end of the stay.

 

Article 3 - conclusion du contrat : La réservation devient effective dès lors que le participant aura fait parvenir au propriétaire les arrhes indiqué au recto ainsi que le contrat signé avant la date indiquée

Le participant déclare qu’il occupera personnellement le bien loué, pour occuper le bien loué dans le respect de sa destination et pour en assurer l'entretien normal. La location conclue entre les parties au présent acte ne peut en aucun cas bénéficier même partiellement à des tiers, personnes physiques ou morales, sauf accord écrit du propriétaire.

Toute infraction à ce dernier alinéa serait susceptible d'entraîner la résiliation immédiate de la location aux torts du participant, le produit de la location restant définitivement acquis au propriétaire - Conclusion of the contract: The reservation becomes effective once the participant has sent the owner the deposit indicated on the front as well as the signed contract. The participant declares that he will personally occupy the rented property, to occupy the rented property in accordance with its purpose and to ensure its normal maintenance. The rental concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, natural or legal persons, unless the owner agrees in writing. Any violation of this last paragraph would be likely to result in the immediate termination of the rental due to the participant's fault, the rental proceeds remaining definitively acquired by the owner

 

Article 4 - annulation par le participant : Toute annulation doit être notifiée au propriétaire, avec accusé de réception.

a) annulation avant l'arrivée dans les lieux : les arrhes (50% du montant du séjour) restent acquises au propriétaire. Celui-ci pourra demander le solde du montant du séjour, si l'annulation intervient moins de 28 jours avant la date prévue d'entrée dans les lieux (Vous pouvez éventuellement souscrire une assurance annulation, qui vous remboursera en cas de force majeure, merci de contacter votre assureur) - cancellation by the participant: Any cancellation must be notified to the owner, with acknowledgement of receipt.

a) cancellation before arrival at the premises: the deposit (50% of the amount of the stay) remains acquired by the owner. The latter may request the balance of the amount of the stay, if the cancellation occurs less than 28 days before the scheduled date of entry into the premises (You can take out cancellation insurance, which will reimburse you in the event of force majeure. Please contact your insurer for this.)

 

Si le participant ne se manifeste pas dans les 24 heures qui suivent la date d'arrivée indiquée sur le contrat, le présent contrat devient nul et le propriétaire peut disposer de son gîte. Les arrhes restent également acquises au propriétaire qui demandera le solde de la location - If the participant does not show up within 24 hours of the arrival date indicated on the contract, this contract becomes null and void and the owner can dispose of his lodging. The deposit also remains acquired by the owner who will request the balance of the rental

b) si le séjour est écourté par le participant, le prix du séjour reste acquis au propriétaire. Il ne sera procédé à aucun remboursement/ b) If the stay is shortened by the participant, the price of the stay remains acquired by the owner. No refund will be made

 

Article 5 - annulation par le propriétaire : Le propriétaire reverse au participant l’intégralité des sommes versées par avance/ Cancellation by the owner: The owner will refund to the participant the full amount paid in advance

*Le cours se déroulera avec un nombre minimum de participants. Vous saurez au plus tard le 1er juillet si le cours peut avoir lieu. S'il y a suffisamment de participants, le voyage vous sera immédiatement confirmé. –

The course will take place with a minimum number of participants. You will know by July 1st at the latest if the course can take place. If there are enough participants, the trip will be confirmed to you immediately.

 

Article 6 - Arrivée : Le participant arrive le jour et à l'heure précisés dans le présent contrat. En cas d'arrivée tardive ou différée, le participant prévient le propriétaire - Arrival: The participant arrives on the day and at the time specified in this contract. In the event of late or delayed arrival, the participant shall notify the owner

 

Article 7 - règlement du solde : Le solde est versé six semaines avant l'entrée dans les lieux - payment of the balance: The balance is paid six weeks before entering the premises

 

Article 8 - état des lieux : le participant est réputé avoir reçu le bien loué en bon état et doit le restituer comme tel (article 1731 du Code Civil) - inventory: the participant is deemed to have received the rented property in good condition and must return it as such (article 1731 of the Civil Code)

 

L'état de propreté est vérifié à l'arrivée du participant. Les réclamations formulées plus de 24 heures après l'arrivée dans le bien loué ne seront pas traitées. Le nettoyage de la propriété lors d'une utilisation normale est à la charge du propriétaire. En cas d'usage anormal (ex. salissures excessives nécessitant un nettoyage approfondi), des frais de ménage supplémentaires pourront être facturés. Il est interdit de fumer dans le gîte, dans l'orangerie et sur la terrasse de la piscine. - The state of cleanliness is checked upon the participant's arrival. Complaints made more than 24 hours after arrival in the rented property will not be processed. Cleaning the property during normal use is the responsibility of the owner. In the event of abnormal use (e.g. excessive soiling requiring thorough cleaning), additional cleaning fees may be charged. Smoking is prohibited in the cottage, in the orangery and on the pool terrace.

 

Article 9 - Dépôt de garantie ou caution : N/A

La propriété est louée meublée et équipée. Si nécessaire, le propriétaire ou son représentant est en droit de facturer un montant pour le nettoyage (supplémentaire) du bien loué au départ du participant, ainsi qu’un montant pour la valeur d’objets, de meubles ou de matériaux brisés, contaminés ou détruits ou endommagés et les objets qui ont été utilisés pendant la location autres que ceux pour lesquels ils étaient destinés, donc l’indemnisation de tout dommage causé.

 

Security deposit or bond: N/A

The property is rented furnished and equipped. If necessary, the owner or his representative is entitled to charge an amount for (additional) cleaning of the rented property upon departure of the participant, as well as an amount for the value of broken, contaminated or destroyed or damaged objects, furniture or materials and objects that have been used during the rental other than those for which they were intended, therefore compensation for any damage caused.

Article 10 - utilisation des lieux : Le participant utilise les lieux conformément à leur destination. Le participant ne peut refuser au propriétaire l'accès au bien loué si le propriétaire ou son représentant le demande ou - par exemple en l'absence du participant - le propriétaire le juge nécessaire. - Use of the premises: The participant uses the premises in accordance with their intended purpose. The participant may not refuse the owner access to the rented property if the owner or his representative requests it or - for example in the absence of the participant - the owner deems it necessary.

Article 11 - capacité : Le présent contrat est établi pour une personne. Toute modification ou rupture du contrat sera considérée à l’initiative du participant. Cela peut conduire le propriétaire à résilier le contrat prématurément, sans que (une partie du) prix d'hébergement convenu ne soit restitué. Cela peut également entraîner des frais supplémentaires pour le participant - Capacity: This contract is established for one person. Any modification or termination of the contract will be considered at the initiative of the participant. This may result in the owner terminating the contract prematurely, without (part of) the agreed accommodation fee being returned. It may also result in additional costs for the participant.

 

Article 12 - animaux : Le présent contrat précise que le participant ne peut pas séjourner en compagnie d'un animal domestique. En cas de non-respect de cette clause par le participant, le propriétaire peut refuser le séjour. Dans ce cas, aucun remboursement ne sera effectué - Animals: This contract specifies that the participant cannot stay with a domestic animal. In the event of non-compliance with this clause by the participant, the owner may refuse the stay. In this case, no refund will be made.

 

Article 13 - assurances : Le participant est responsable de tous les dommages survenant de son fait. Il est tenu d’être assuré en responsabilité civile - Insurance: The participant is responsible for all damages caused by him. He is required to have civil liability insurance

 

Article 14 - paiement des charges : Les charges d’eau, de fioul et d’électricité sont comprises dans le prix de location, pour un usage normal. En cas d’utilisation anormale, les charges pourront être refacturées au participant. L'électricité ne peut pas être utilisée pour recharger votre voiture électrique ou hybride. -payment of charges: Water, fuel and electricity charges are included in the rental price, for normal use. In the event of abnormal use, the charges may be re-invoiced to the participant. Electricity cannot be used to recharge your electric or hybrid car.

 

Article 15 - Responsabilité et sécurité : La participation aux vacances se fait à vos propres risques. Si vous avez un problème de santé, signalez-le sur ce formulaire et ayez ces informations avec vous. -  Liability & Safety: Participating in this holiday arrangement is at your own risk. If you have a medical condition, report it on this form and carry this information with you.

 

L'organisateur de ce séjour n'est pas responsable des dommages matériels et immatériels subis par vous ou des dommages causés par vous en tant que participant à des tiers lors de votre séjour - The organizer of this stay is not responsible for any material or immaterial damage suffered by you or for any damage caused by you as a participant to third parties during your stay.

 

Le propriétaire-organisateur de ce séjour n'est pas responsable des pertes ou dommages causés à votre (vos) bien(s)-  The owner-organizer of this stay is not responsible for any loss or damage caused to your property(ies)

Nous prenons en compte au maximum vos besoins alimentaires. Le propriétaire-organisateur décline toute responsabilité en cas de réactions allergiques dues à des allergies que vous n'auriez pas signalées/ We take your dietary needs into account as much as possible. The owner-organizer declines all responsibility in the event of allergic reactions due to allergies that you have not reported.

 

Article 16 - litiges : Toute réclamation concernant ce contrat sera traitée par le tribunal competent. En cas de litige, les parties s'engagent à tenter une médiation avant toute procédure judiciaire -Disputes: Any claim concerning this contract will - if applicable - be dealt with by the competent (French) court. In the event of a dispute, the parties undertake to attempt mediation before any legal proceedings.
